New York Lease renewal / non-renewal notice

Last reviewed 2026-10-15

Does a landlord have to give notice before not renewing a lease in New York?

Before not renewing a tenancy, or renewing with a rent increase of 5% or more, the landlord must give written notice of 30, 60 or 90 days depending on how long the tenant has lived there or the lease length. If notice is late, the tenancy continues until the notice period runs.
