Last reviewed 2026-10-15

What happens if a tenant stays after the lease ends in Texas?

Before filing an eviction suit against a tenant who is in default or who holds over after the lease or renewal period ends, the landlord must give at least 3 days' written notice to vacate, unless a written lease sets a shorter or longer period.
