Nevada Rent withholding / escrow

Last reviewed 2026-10-17

Can a tenant withhold rent for repairs in Nevada?

In Nevada, if the landlord willfully or negligently fails to supply heat, air conditioning, water, hot water, electricity, gas, a working door lock or another essential service, making the home unfit, and does not fix it within 48 hours (excluding weekends and holidays) after written notice, the tenant may withhold rent that comes due until the landlord makes a good-faith attempt to restore it. Other remedies include buying the service and deducting its cost, or moving to comparable housing while rent abates. Statute text: "Withhold any rent that becomes due during the landlords noncompliance without incurring late fees" (NRS 118A.380(1)(c)).
