Texas Early termination (DV/military)

Last reviewed 2026-10-15

Can a tenant break a lease early for domestic violence or military service in Texas?

Family violence: a tenant can end the lease and avoid future rent by giving the landlord a protective order or other qualifying documentation and written notice at least 30 days ahead, then moving out after the 30 days run (§ 92.016). Military: a servicemember or dependent can end the lease with written notice plus proof of entry into service or orders. For monthly leases, termination takes effect 30 days after the next rent due date. The landlord must refund prepaid rent within 30 days (§ 92.017).
