North Carolina Short-term rentals (Airbnb)

Last reviewed 2026-10-18

What are the Airbnb / short-term rental rules in North Carolina?

North Carolina's Vacation Rental Act covers rentals of homes, condos and cottages for vacation or leisure for fewer than 90 days to guests who have a permanent home elsewhere. It requires a written vacation rental agreement with a set notice, treats unlabeled extra funds as a security deposit that must go into a trust account, and lets the landlord use an expedited eviction for stays of 30 days or less (holdover, material breach or unpaid rent). Statute text: "The rental of residential property for vacation, leisure, or recreation purposes for fewer than 90 days by a person who has a place of permanent residence to which he or she intends to return." (N.C. Gen. Stat. §§ 42A-4(3), 42A-18(a), 42A-23(a) (Vacation Rental Act)).
