Last reviewed 2026-10-17

What rights does a tenant have after foreclosure in North Carolina?

After a North Carolina power-of-sale foreclosure, the clerk can order occupants removed only after 10 days' notice to those in possession, or 30 days' notice for residential property with 15 or more rental units. The federal Protecting Tenants at Foreclosure Act also applies. Statute text: "Ten days' notice has been given to the party or parties who remain in possession at the time application is made, or, in the case of residential property containing 15 or more rental units, 30 days' notice has been given" (N.C. Gen. Stat. § 45-21.29(k)(5)).
