Indiana Repair and deduct
Can a tenant fix something and deduct it from rent in Indiana?
The remedy Indiana's landlord-obligations chapter (IC 32-31-8, read in full) gives tenants is a court action, not repair-and-deduct. The tenant must first give the landlord notice and a reasonable time to repair, and must allow access for repairs. If the landlord fails or refuses, a winning tenant can recover actual and consequential damages, attorney's fees and court costs, an injunction, or other appropriate relief. The landlord must keep the unit safe, clean and habitable, follow health and housing codes, and maintain the electrical, plumbing, sanitary, heating and air conditioning systems and supplied appliances. Statute text: "A tenant may bring an action in a court with jurisdiction to enforce an obligation of a landlord under this chapter." (Ind. Code §§ 32-31-8-5, 32-31-8-6).
