Florida Repairs and habitability remedies
What can a tenant do if the landlord won't make repairs in Florida?
The tenant may give written notice of the landlord's material failure to maintain (§ 83.51(1)) and, 7 days later, withhold rent. The noncompliance is then a complete defense to a nonpayment eviction, and the court may reduce the rent. Florida has no repair-and-deduct statute in ch. 83.
