In Florida, a person who rents or negotiates the rental of real property for another for compensation is a "broker" and must hold an active real estate license. Operating as a broker without one is a third-degree felony under Fla. Stat. § 475.42(1)(a). Statute text: "appraises, auctions, sells, exchanges, buys, rents, or offers, attempts or agrees to appraise, auction, or negotiate the sale, exchange, purchase, or rental of business enterprises or business opportunities or any real property" (Fla. Stat. §§ 475.01(1)(a), 475.42(1)(a)).
