West Virginia Smoke & CO detectors
Does a landlord have to provide smoke and carbon monoxide detectors in West Virginia?
Owners of one- and two-family dwellings (including manufactured homes) must provide, install and replace smoke detectors near each sleeping area; in rented dwellings the tenant does routine maintenance. The same section also requires carbon monoxide detectors in rented one- and two-family dwellings with fuel-burning appliances. Statute text: "The owner of each dwelling described in subsection (a) of this section shall provide, install, and replace the operational smoke detectors required by this section" (W. Va. Code § 15A-10-12(b)).
