South Carolina Late fee grace period

Last reviewed 2026-10-15

Is there a grace period before a late fee can be charged in South Carolina?

S.C. Code ch. 27-40 (read in full on 2026-10-15) sets no late-fee grace period or cap. The landlord can terminate for nonpayment only if rent stays unpaid for 5 days after the due date, with written notice (which can be given once, in the lease).
