North Dakota Short-term rentals (Airbnb)

Last reviewed 2026-10-19

What are the Airbnb / short-term rental rules in North Dakota?

North Dakota requires a state license from the Department of Health and Human Services (or an approved local health unit) before a "lodging establishment" operates. The definition covers places furnishing sleeping accommodations to transient guests for a charge, but excludes a single structure with five or fewer guest rooms and ten or fewer total occupants, so most whole-home short-term rentals fall outside the state lodging license. Statute text: "The term does not include single structures with five or fewer guest rooms and ten or fewer total occupants" (N.D.C.C. §§ 23-09-01(9), 23-09-16).
