Missouri Foreclosure tenant protections
What rights does a tenant have after foreclosure in Missouri?
After a Missouri foreclosure sale, the new owner must give a residential tenant who was in the property before the foreclosure written notice that the sale happened, who the new owner is, and that the tenant has at least 10 business days to move out. No eviction can be filed during those 10 business days. Missouri law does not create a tenancy with the new owner, but federal law (the Protecting Tenants at Foreclosure Act) can give bona fide tenants more time. Statute text: "the new owner of the property shall give the occupant notice, as described in subsection 3 of this section, that the sale has occurred, that they are the new owner, and if said owner seeks possession from the occupant that the occupant has not less than ten business days from the date of this notice to vacate the premises" (RSMo § 534.030(2)-(3)).
