Kansas Short-term rentals (Airbnb)
What are the Airbnb / short-term rental rules in Kansas?
Under the Kansas Lodging Inspection Act, anyone in the business of running a "lodging establishment" needs a license from the Secretary of Agriculture, issued after an inspection. Lodging establishments include a "hotel" (four or more rooms offered for pay primarily to transient guests) and a "guest house" (a building held out as a place where sleeping accommodations are furnished for pay to transient or permanent guests, for no more than seven guests in no more than three rooms). A short-term rental that fits one of these definitions needs the state license. Statute text: "It shall be unlawful for any person to engage in the business of conducting a lodging establishment unless such person shall have in effect a valid license therefor issued by the secretary." (K.S.A. 36-501(b)(1), (4), (6); 36-502(a)).
